Guardianships in Texas
In Texas, obtaining guardianship is a complex process. Before beginning this process, our elder law attorneys will take care to determine whether or not seeking guardianship is the best solution for you and your family.
Guardianship of the person: A guardian of the person is responsible for the personal welfare of the "ward." The guardian of the person makes decisions regarding food, clothing, shelter, and health care of the ward. The guardian has the duty to provide care, supervision, and protection for the ward. In addition, the guardian has the power to consent to medical, psychiatric, and surgical decisions.
Guardianship of the estate: A guardian of the estate has the power to manage all property belonging to the ward, including collection of monies owed, and to bring and defend suits on behalf of the ward. The guardian of the estate is a fiduciary of the ward and is answerable to the ward and the supervising court for their management of the ward's assets. A guardian of the estate has to apply to the supervising court to make expenditures for the ward's benefit.
Typically, one person serves as both the guardian of the person and the guardian of the estate. Our lawyers are available to help people in Houston and throughout Texas obtain guardianship over people they care about.
Our lawyers are also available to provide litigation services to people involved in probate and guardianship litigation.
